PUBLIC NOTICE

SUBSTITUTE TRUSTEE’S NOTICE OF SALE

Notice is hereby given that on April 29, 2026 beginning at 2:00 p.m. eastern time on the front steps of the Carter County Courthouse located at 801 East Elk Avenue in Elizabethton, Tennessee, the undersigned, in its capacity as Substitute Trustee, having been so appointed by an Appointment of Substitute Trustee of record in the Register’s Office for Carter County, Tennessee, in Book 633, Page 691, to which reference is expressly made, under Deed of Trust executed by CAB Properties, LLC (“Grantor”) to the Trustee, Lawrence F. Counts, dated September 13, 2024 (“Deed of Trust”), of record in said Register’s Office in Book 576, Page 227, to which reference is expressly made; and by reason of default in the payment of the obligations secured by the Deed of Trust, and the performance of the covenants contained therein, will sell at public auction to the highest bidder for cash, the interests conveyed to said Substitute Trustee by the Deed of Trust against the two tracts of real property therein described (collectively the “Property”), to-wit:

SITUATE, lying and being in the 15th Civil District of Carter County, Tennessee, and being more particularly described as follows, to-wit:

Tract #1

BEING Lots 32 and 33, Block No. 21, of the Cooperative Town Company’s Addition to the City of Elizabethton, Tennessee, according to plat of said addition of record in the Register’s office for Carter County, Tennessee, at Elizabethton, Tennessee, in Deed Book 15, Page 574, to which reference is here made; said lots fronting 25 feet each on the north side of Elk Avenue and running back of even width a distance of 115 feet to an alley; and upon which property is situated a brick business building known as the Ritz Theatre Building.

AND BEING the same property conveyed to CAB Properties, LLC, a Tennessee limited liability company, by Warranty Deed dated the 6th day of December, 2022 from Beatrice S. Montgomery of record in Book 510, Page 250 in the Register’s Office for Carter County, Tennessee, to which reference is here made.

BEGINNING at a point in the south property line of “E” Street a distance of 100 feet west of the southwest point of intersection of Sycamore Street and “E” Street thence with the line of “E” Street in a westerly direction a distance of 50 feet to a point in same; thence at right angle to “E” Street and in a southerly direction parallel to Sycamore Street a distance of 115 feet to a point in north line of an alley; thence in an easterly direction with the line of said alley a distance of 50 feet to a point in the same; thence in a northerly direction and at right angle to said alley and parallel with Sycamore Street a distance of 115 fee to the point of BEGINNING, being also known and described as Lot Nos. 5 and 6, in Block 21 of the Co-Operative Town Company’s Addition to the Town of Elizabethton, Tennessee, as per plat of record in Deed Book 15, Page 574, to which reference is here made.

AND BEING the same property conveyed to CAB Properties, LLC, a Tennessee limited liability company, by Warranty Deed dated the 6th day of December, 2022 from the Estate of Brian Keith Montgomery by Sherri K. Montgomery, sole heir of record in Deed Book 510, Page 253 in the Register of Deeds Office for Carter County, Tennessee, to which reference is here made.

The foregoing addresses and Carter County Assessor’s references for the Property are believed to be correct. Such references, however, are not part of the Property’s legal descriptions, and in the event of any discrepancy, the legal descriptions stated in this notice shall be controlling.

Grantor waived all rights of equity of redemption and all rights of redemption, statutory or otherwise (including, without limitation, those rights of redemption contained in Tenn. Code Ann. § 66-8-101, et seq.), homestead, dower, elective share, rights of appraisement or valuation, and all other rights and exemptions of every kind.

The sale of the Property is subject to any setbacks, restrictions, reservations, requirements, and conditions of record applicable to the Property, which may include, but is not limited to, the accuracy of and reservations and easements on that plat of the Cooperative Town Co.’s Addition recorded in the Register’s Office for Carter County, Tennessee in Deed Book 15, Page 574 and on Slide A-327, Page B-50, references to which are expressly made. The sale of the Property is further subject to deeds of easement, etc., if any, any issue that a survey of the Property may identify, and any unpaid city and/or county real estate taxes or personal property taxes owed against the Property shall purchaser’s responsibility.

TERMS OF SALE: CASH or CERTIFIED GOOD FUNDS ONLY (10% deposit due on day of sale, balance due in full at closing within fifteen (15) days from day of sale). Any purchaser shall pay all recording fees and taxes, examination of title settlement fees, and all costs of conveyance, including drafting of a Substitute Trustee’s Deed(s). Any Substitute Trustee’s Deed(s) shall be made without any covenants or warranties either express or implied. The sale of the Property is subject to the rights of any occupants in possession. It shall be the successful purchaser’s responsibility to obtain possession of the Property at his/her/its own expense.

The Property, and all improvements thereon, if any, will be sold AS IS, WHERE IS, and WITH ALL FAULTS without warranties or representations of any kind. The aforesaid sale may be postponed to a later date or time by oral announcement at the time and place of the published sale or cancelled without further notice or publication.

The Substitute Trustee reserves the right to take or accept the next highest or best bid at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. The Substitute Trustee also reserves the right to reopen the bidding or republish and sell the Property at its option. The beneficiary named in the Deed of Trust may become the purchaser at the sale. The Substitute Trustee shall apply the sale proceeds in accordance with the provisions of the Deed of Trust. The Substitute Trustee reserves the right to waive the deposit requirement, to extend the period within which the purchaser(s) is to make full payment, to withdraw the Property from sale at any time prior to the termination of bidding, to keep the bidding open for any length of time, to reject all bids, or to rescind the sale. Should the Substitute Trustee rescind the sale of the Property for any reason, any purchaser(s) will only be entitled to the return of any money paid towards the purchase price and that purchaser(s) will have no other recourse either in law or equity.

The Substitute Trustee reserves the right to conduct the sale by or through its agents or attorneys acting in its place or stead, including the use of an auctioneer.
