PUBLIC NOTICE

TRUSTEE’S SALE
UNDER AND BY VIRTUE OF AUTHORITY vested in the undersigned Trustee, and in execution of that certain Deed of Trust made by Lonnie Ray Pierce, dated the 19th day of July 2019, and recorded in Trust Book 357, Page 354, at the Register’s Office of Carter County, Tennessee, default having been made in the payment of indebtedness thereby secured, the undersigned Trustee, at the request of the holder of said Note, will offer for sale at public auction at the front door of the Carter County Courthouse located at 801 Elk Avenue, Elizabethton, TN 37643, on the 7th day of June, , at 10:00 a.m. (ET) the following described parcel of land and improvements:
SITUATE in the Fourteenth (14th) Civil District of Carter County, Tennessee, and being more particularly described as follows:
To Find the Point of Beginning, begin at an iron pin set in Long Hollow Road, corner to Lloyd Merritt and Arnold Vines; thence with the line of Vines and Merritt, the following four calls and distances, to-wit: North 72 deg. 42 min. 08 sec. West, 60.64 feet to an iron pin; South 66 deg. 31 min. 50 sec. West, 59.57 feet to an iron pin; South 48 deg. 09 min. 45 sec. West, 103.99 feet to an iron pin; South 43 deg. 56 min. 29 sec, West 50.84 feet to an iron pin, the point of BEGINNING; thence continuing with the line of Lloyd Merritt (Deed Book 155, Page 489), the following three calls and distances to-wit South 43 deg. 42 min. 40 sec. West, 214.50 feet to an 10” oak; South 42 deg. 33 min. 07 sec. West, 99.00 feet to a 12” oak; thence South 61 deg. 05 min. 44 sec. East, 107.25 feet to an iron pin, corner to Arnold Vines (Deed Book 343, Page 598 and Deed Book 256, Page 463); thence with the line of Vines, the following two calls and distances, to-wit: North 26 deg. 79 min. 25 sec. East, 131.98 feet to an iron pin; North 21 deg. 13 min. 59 sec. East, 173.28 feet to the point of BEGINNING, and containing .402 acres, more or less, as shown by survey dated December 20, 1999, entitled “Survey of the G.W. and Phyllis Hughes Property” prepared by Steven G. Pierce, TRLS # 1564, Iron Mountain Survey Co., 519 East “E” Street, Elizabethton, Tennessee 37643.”
BEING the same property conveyed to Lonnie Ray Pierce from Jack A. Keene and wife, Sandra Keene by Warranty Deed dated July 19, 2019, recorded July 23, 2019 @ 1:22 p.m., of record in Book 357, Page 351, Register’s Office for Carter County, Tennessee.
ADDRESS OF PROPERTY: 196 Long Hollow Rd, Elizabethton, TN
TERMS OF SALE: CASH. A bidder’s deposit of ten percent (10%) will be required. The entire amount of the successful bid must be paid in full, in cash within thirty (30) days after sale. Purchaser shall pay all recording fees, examination of title, settlement fees, and all costs of conveyance, including preparation of a Deed of Bargain and Sale by Special Warranty.
The sale is subject to conditions, restrictions, rights-of-way easements and reservations contained in the Deeds forming the chain of title to this property. Any improvements on subject property will be sold in “as is” condition without warranty of any kind. Sale is made in bar of all homestead, dower, and curtsy, and in bar of the right of equity of redemption and the statutory right of redemption, all of which are expressly waived in the Deed of Trust. It will be the responsibility of the successful bidder to obtain possession of the property at his expense. The successful bidder shall be responsible for any damage, vandalism, theft, destruction, etc., of the property occurring subsequent to the date of sale. This sale is subject to prior liens, judgments or unpaid taxes, if any.
If applicable, the notice of right to foreclose requirements of T.C.A. §35-5-117 have been met.
This sale is further subject to valid filed or unfiled (if any) mechanic’s and materialmen’s liens. There are no representations made by the Trustee as to the validity or enforceability of any memorandum of mechanic’s or materialmen’s liens or of any suit to enforce same.
The Trustee reserves the right: To waive the deposit requirement; To extend the period of time within which the Purchaser is to make full settlement; To withdraw the property from sale at any time prior to the termination of the bidding; To keep the bidding open for any length of time; To reject all bids; To postpone or set over the date of sale; and Should the highest bidder fail to comply with the terms of the bid at public sale, then the Trustee shall have the option of accepting the second (2nd) highest bid, or the next highest bid with which the buyer is able to comply.
In the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, such notice or postponement or setting over will be in a manner deemed reasonable by the Trustee.
