PUBLIC NOTICE

NOTICE OF SUBSTITUTE TRUSTEE’S SALE

WHEREAS, Vickie L. Little delivered to David L. Mahaffey, Trustee, a certain Deed of Trust dated August 29, 2007, found of record in Book T811, Page 764, in the Register’s Office for Carter County, Tennessee, to secure a certain indebtedness fully described therein, which indebtedness is now due and unpaid, and has been declared in default by the lawful owner and holder thereof; and
WHEREAS, by Appointment of Substitute Trustee dated November 17, 2022 and recorded in Book 508, Page 165, in the Register’s Office for Carter County, Tennessee, Brett N. Mayes was appointed as Substitute Trustee pursuant to the terms of said Deed of Trust; and
WHEREAS, the owner and holder of the secured indebtedness and beneficial interest of the Deed of Trust is Bank of Tennessee, a Tennessee banking corporation, 10431 Wallace Alley Street, Kingsport, Tennessee 37663, as the successor by merger to Carter County Bank, a Tennessee banking corporation; and
WHEREAS, default has been made in the payment of said indebtedness and the same has become due and payable, and the owner and holder of said indebtedness has instructed the said Substitute Trustee to foreclose said Deed of Trust and to advertise and sell the property herein described upon the terms and conditions as set forth in said Deed of Trust.
NOW, THEREFORE, Brett N. Mayes, Substitute Trustee, pursuant to said Deed of Trust, having been requested by the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on the 20th day of December, 2022, at 10:00 A.M., prevailing standard time, at the old Carter County Courthouse door, 801 E. Elk Ave., Elizabethton, Tennessee, 37643, sell at public auction, for cash, to the highest bidder, and in bar of the equitable and statutory rights of redemption, and subject to any and all taxes and any and all assessments, any and all prior encumbrances, if any, the following described real estate as set forth in said Deed of Trust, to-wit:
SITUATED in the 13th Civil District of Carter County, Tennessee, and being more particularly described as follows, to-wit:
TRACT I: BEGINNING at an iron pin which Iron pin is located the following calls from the southwestern intersection of Hart Road and a 20-ft. access right of way, South 29 deg. 42 min. 33 sec. West 224.84 feet; North 54 deg. 06 min. 50 sec. West 44.75 feet; North 35 deg. 53 min. 10 sec. East 10 feet, the beginning corner; thence North 35 deg. 53 min. 10 sec. East 18.15 feet to a point; thence North 54 deg. 06 min. 50 sec. West 78 feet to a point; thence South 35 deg. 53 min. 10 sec. West 18.15 feet to a point; thence South 54 deg, 06 min. 50 sec. East 78 feet to the point of BEGINNING.
There is located on said property a one-unit apartment designated as Unit 1 in Building 5, according to Plat prepared by Joe A. Hale, Surveyor, dated December 11, 1981, and recorded in Misc. Book 39, page 60, in the Register’s Office for Carter County, Tennessee.
There is also conveyed a 20-ft. wide access right of way leading from Hart Road to the property herein conveyed, which right of way is a distance of224.84 feet.
TRACT II: BEING a one-fifth undivided interest as tenants in common in the following described property: BEGINNING at an iron pin in the western boundary line of a 20-ft. access right of way, which point of beginning is located South 29 deg. 42 min. 33 sec. West a distance of 113.45 feet from the southwestern intersection of Hart Road and a 20-ft. right of way; thence North 54 deg. 06 min. 50 sec. West a distance of 160.76 feet to an iron pin; thence South 35 deg. 53 min. 10 sec. West a distance of 110.75 feet to an iron pin; thence South 54 deg. 06 min. 50 sec. East a distance of 172.75 feet to an iron pin in the western line of a 20-ft. access right of way; thence with same North 29 deg. 42 min. 33 sec. East a distance of 111.39 feet to the point of BEGINNING, containing .4239 acres, more or less, according to survey of Joe A. Hale, dated Dec. 11, 1981.
There is EXCEPTED from the above-described property a tract of land containing a building with five living units; Units 1, 3 and 5 are located on a lot 18.15 feet x 78 feet; and Units 2 and 4 are located on a lot 18.15 x 84 feet, as shown by survey of Joe A. Hale herein referred to.
This conveyance is expressly made subject to the provisions of the restrictive covenants relating to this property as set out in Misc. Book 39, page 60, Register’s Office for Carter County, Tennessee, which includes certain responsibilities that the party of the second part will have relative to the maintenance of the property herein conveyed, and which are expressly assumed by party of the second part by acceptance of this instrument.
BEING the same property conveyed to Chester T. Little and wife, Vickie L. Little by Deed from Arlene B. Gaal, dated the day of August, 1992, and of record at Deed Book 395, page 509, Register’s Office for Carter County, Tennessee. Chester T. Little is now deceased, having died on or around September 2, 2000.

This conveyance is made subject to all valid restrictive covenants and easement, if any, of record, or which may be apparent from an inspection of the premises.

SALE IS SUBJECT TO TENANT(S) RIGHTS IN POSSESSION.
The sale will be made as Substitute Trustee only, without covenants of seizen or warranties or title, subject to unpaid taxes and assessments owing on the property, and subject to all liens, encumbrances, easements, right-of-way, set-back lines, restrictions, and covenants affecting the subject property having priority over the lien created by the subject deed of trust.
OTHER LIENHOLDERS:
1) Judgment in favor of Ford Motor Credit Company, LLC, dated January 9, 2013, of record in Book 149, Page 522 in the aforementioned Register’s Office, being extended by Order Extending Judgment dated August 26, 2022, of record in Book 503, Page 539 in the aforementioned Register’s Office.
OTHER INTERESTED PARTIES: N/A.
The proceeds derived from the sale of said property will be applied toward payment of the indebtedness, including interest and attorney’s fees secured by said Deed of Trust, and the balance, if any, to be paid to the parties legally entitled. The sale held pursuant to this notice may be rescinded at the Substitute Trustee’s option at any time. The right is reserved to adjourn the date of the sale to another date, time and place certain without further publication, upon announcement of the time and place for the sale set forth above.
